Terms of Use

1. Acceptance of Terms

By downloading, installing, or using Fishtime ("the App"), you agree to be bound by these Terms of Use. If you do not agree to these terms, please do not use the App.

2. License

Fishtime grants you a limited, non-exclusive, non-transferable, revocable license to use the App for personal, non-commercial purposes, subject to these Terms. This license is provided to you when you purchase or download the App through the Mac App Store.

You may not:

  • Modify, reverse engineer, decompile, or disassemble the App
  • Rent, lease, lend, sell, redistribute, or sublicense the App
  • Use the App for any illegal or unauthorized purpose
  • Remove any copyright or other proprietary notices from the App
  • Use the App to develop a competing product

3. App Store Terms

Your use of Fishtime is also governed by the terms and conditions of the Mac App Store from which you obtained the App, including Apple's Licensed Application End User License Agreement. In the event of any conflict between these Terms and the App Store terms, the App Store terms shall prevail.

4. Camera Permission

Fishtime requires access to your Mac's camera to enable the face-aware break detection feature. By using this feature, you consent to the App accessing your camera under the following conditions:

  • Camera access is only active when a fish bites (during break reminders)
  • All processing occurs locally on your device
  • No video or images are recorded, stored, or transmitted

You can revoke camera permission at any time in System Settings > Privacy & Security > Camera, though this will disable the automatic break detection feature.

5. Health Disclaimer

Fishtime is designed to encourage healthy screen habits based on the 20-20-20 rule and Pomodoro technique. However:

  • The App is not a medical device
  • The App does not provide medical advice
  • Always consult a healthcare professional for eye health concerns
  • We make no guarantees about specific health outcomes

Use Fishtime as a helpful tool, but listen to your body and seek professional advice when needed.

6. Disclaimer of Warranties

THE APP IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, OR NON-INFRINGEMENT.

We do not warrant that:

  • The App will meet your specific requirements
  • The App will be uninterrupted, timely, secure, or error-free
  • The results from using the App will be accurate or reliable
  • Any errors in the App will be corrected

7. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT SHALL FISHTIME OR ITS CREATORS BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING WITHOUT LIMITATION, LOSS OF PROFITS, DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES, RESULTING FROM:

  • Your access to or use of, or inability to access or use, the App
  • Any conduct or content of any third party related to the App
  • Any content obtained from the App
  • Unauthorized access, use, or alteration of your transmissions or content

8. Termination

These Terms shall remain in effect until terminated by you or us. We may terminate or suspend your license to use the App immediately, without prior notice or liability, for any reason whatsoever, including without limitation if you breach these Terms.

Upon termination, your right to use the App will immediately cease. All provisions of these Terms which by their nature should survive termination shall survive.

9. Changes to Terms

We reserve the right to modify or replace these Terms at any time. If a revision is material, we will provide at least 30 days' notice prior to any new terms taking effect. What constitutes a material change will be determined at our sole discretion.

By continuing to access or use the App after any revisions become effective, you agree to be bound by the revised terms.

10. Governing Law

These Terms shall be governed and construed in accordance with the laws applicable in your jurisdiction, without regard to its conflict of law provisions.

Our failure to enforce any right or provision of these Terms will not be considered a waiver of those rights. If any provision of these Terms is held to be invalid or unenforceable, the remaining provisions will remain in effect.
